County Circuit Judge Lester Foreman rejected arguments of pension fund attorneys that Edgar was usurping the governor's power by deciding how to appropriate money. He said Edgar was merely transferring funds under authority delegated to him by the state legislature. Foreman put a temporary freeze on the money earlier this month. If he had made it permanent, Edgar would have been forced to make an additional $21 million in budget cuts. Attorney Clinton Krislov, who filed the class-action lawsuit on behalf of the 130,000 workers in the pension system, said the decision poses no immediate risk to employee funds.
"They're not going to run out of funds today, tomorrow or next Krislov said. "It's a case of being penny-wise and pound-foolish. The state is going to have to come up with this money now or later."
